Efforts by Herman Hembe to have a re-trial of the case that led to his sack as the member representing Vandeikiya/Konshisha federal constituency of Benue State in the House of Representatives has failed.
The Supreme Court on Wednesday dismissed the case, saying it could not be revisited.
The court had on June 23 sacked Hembe from the House of Representatives for wrongfully occupying the office.
Dorathy Mato, was declared as duly elected for the office and the Independent National Electoral Commission (INEC) was directed to issue her the certificate of return.
Hembe was also directed to return all the salaries and allowances he received while in office.
In his application, however, Hembe pleaded that the court should wave the order directing him to refund the money he had collected.
According to him, he had no many to pay.
But in its ruling, the five-man panel of judges led by the Chief Justice of Nigeria, Walter Onnoghen, the judgement could not be revisited.
The court also awarded the sum of N1 million to Mato.
