The Economic and Financial Crimes Commission (EFCC), Uyo Zone has been dragged before a Vacation Court in the High Court of Akwa Ibo, Uyo Judicial Division for human rights violation.
Ubong Williams, who is alleging violation of his fundamental rights, in the suit, joined Edeh Uchenna, Head of EFCC Zonal Office Uyo and Segun Richard, case officer as 2nd and 3rd Respondents respectively.
He is demanding the sum of Twenty Million Naira (N20,000,000.00) only against the Respondents as damages for the violation of the his fundamental rights.
The application, which is brought pursuant to Order II Rules I of the Fundamental Rights (Enforcement Procedure) Rules, 2009, Sections 34, 35 and 36 of the Constitution of the Federal Republic of Nigeria 1999 (as Amended) and under the inherent jurisdiction of the court is supported by a 31 paragraph affidavit.

Other reliefs sought by the applicant include a declaration that the arrest and detention of the Applicant by the 2nd & 3rd Respondents is a violation of the Applicant’s Fundamental Rights; a declaration that the harassment, intimidation, psychological trauma and incessant invitations of the Applicant by the 2nd and 3rd Respondents is an infringement of the Applicant’s Fundamental Right of Dignity of his person and a declaration that the cutting of the electric fence wire, jumping over the fence, breaking the Security doors to gain access to the residential home of the Applicant by 3rd Respondent and other officers of the 1st Respondent is a breach of the Applicant’s Fundamental Right to private life as guaranteed under Section 37 of the Constitution.
The applicant is also praying the court for an order of perpetual injunction restraining the 1st Respondent, its agents, servants or any other person acting for and on its behalf from arresting, detaining or from continuous arresting and detaining of the Applicant as well as order for unreserved apology to be tendered by the Respondents to the Applicant for the violation of the Applicant’s Fundamental Rights and further Order for the publication of the apology in a national newspaper.
According to a supporting affidavit filed by Enoto Akpabio, Esq, on behalf of the applicant, on 1st September, 2020, the 3rd Respondent and his team cut the electric fence wire in the applicant’s house, jumped over the fence, broke the Security doors and bundled the Security man and took him to their office on September 1, 2020 and that the following day, when he visited to complain, he was maltreated, harrased, intimidated and detained
